Article 1 — Purpose and scope
Section titled “Article 1 — Purpose and scope”These Terms of Service (hereinafter “ToS”) govern the contractual relationship between the publisher of the A11y Audit — WCAG 2.2 plugin (hereinafter “the Publisher”), accessible via the Figma Community, and any natural or legal person (hereinafter “the Customer”) who has subscribed to a paid plan (Pro or Team) or uses the free plan (Free) of the plugin.
A11y Audit is a Figma plugin designed to assist with accessibility auditing based on WCAG 2.2 criteria. It runs entirely within the Customer’s Figma environment (local processing). It is neither a compliance certification service nor a legal advice tool.
These ToS apply to the exclusion of all other conditions, including those of the Customer. Any order constitutes acceptance of these ToS as in force at the time of the order.
Article 2 — Service description
Section titled “Article 2 — Service description”2.1 Nature of the service. A11y Audit is an accessibility design aid tool. It automatically checks WCAG 2.2 AA criteria that are algorithmically measurable in Figma mockups (text and UI component contrast, interactive target sizes, text size, presence of alternative texts, heading hierarchy, use of color as the sole information carrier).
2.2 Best efforts obligation. The Publisher undertakes to deploy all reasonable means to ensure the proper functioning of the plugin and the relevance of analyses. The service is provided “as is”. The Publisher does not guarantee that the plugin detects all possible accessibility violations.
2.3 No certification. The A11y Audit plugin does not issue compliance certifications with the EAA directive, WCAG, or any other accessibility standard. A score or PDF report generated by the plugin does not constitute a legal compliance attestation. Full compliance requires an audit of the developed application, including testing with assistive technologies (screen readers, keyboard navigation) by a human expert.
2.4 Criteria not covered. The PDF report explicitly indicates WCAG criteria that cannot be automatically verified in a Figma mockup and require manual verification on the developed application.
Article 3 — Plans and pricing
Section titled “Article 3 — Plans and pricing”3.1 Free plan. Use of the plugin in its free version is unrestricted and without commitment. The Free plan offers one audit per session, a watermarked PDF report, and access to all audit categories. No credit card required.
3.2 Pro plan. Price: €9 excl. VAT per month per seat. Includes unlimited scans, auto-fix, PDF reports without watermark with customizable logo and colors, and email support within 48 business hours.
3.3 Team plan. Price: €29 excl. VAT per month for 5 seats. Includes everything in the Pro plan for five users, team administration dashboard, and priority support within 24 business hours.
3.4 Pricing changes. The Publisher reserves the right to modify its pricing with 30 days’ notice by email. Customers with ongoing subscriptions benefit from the rate in force at their subscription date until the next renewal.
Article 4 — Billing and payment
Section titled “Article 4 — Billing and payment”4.1 Merchant of Record. Payment is processed by LemonSqueezy.com Market Limited (or LemonSqueezy, depending on the checkout platform), acting as Merchant of Record. LemonSqueezy issues the invoice to the Customer, collects payment, and manages tax compliance (VAT).
4.2 VAT. Applicable VAT is automatically determined by LemonSqueezy based on the Customer’s country of residence. Professional customers established in the European Union may provide their EU VAT number during checkout for a net invoice (reverse charge).
4.3 Billing. Billing is monthly, by automatic debit from the credit card or PayPal account provided. The billing date corresponds to the subscription anniversary date.
4.4 Payment failure. In case of payment failure, LemonSqueezy makes two additional automatic attempts. If attempts fail, access to paid features is suspended until regularization. No penalty is applied for a first payment incident.
Article 5 — Termination
Section titled “Article 5 — Termination”5.1 Termination by the Customer. The Customer may cancel their subscription at any time from their LemonSqueezy customer portal, at no cost. Cancellation takes effect at the end of the current monthly period; access to paid features is maintained until that date. No pro-rata refund is made for the current period.
5.2 Right of withdrawal and refund. By way of derogation from Article 5.1, the Publisher grants a full refund within 7 calendar days of the first paid subscription, without justification. The request must be sent to [email protected] from the billing email address.
5.3 Termination by the Publisher. The Publisher may terminate a Customer’s subscription in case of serious and uncorrected violation of these ToS or Figma’s terms of service, after email notice remaining unanswered for 15 calendar days. In case of termination at the Publisher’s initiative without fault of the Customer, the unconsumed portion of the subscription is refunded pro-rata.
Article 6 — Service availability
Section titled “Article 6 — Service availability”6.1 SLA. The Publisher undertakes to maintain license validation service availability at 99% per month (excluding planned maintenance). The plugin itself running in the Customer’s Figma environment, its availability also depends on Figma’s availability.
6.2 Maintenance. Planned maintenance is announced by email with 48 hours’ notice. It preferably takes place outside French business hours (6pm–6am CET).
6.3 Support. Free plan: email support, response within 72 business hours. Pro plan: response within 48 business hours. Team plan: response within 24 business hours. Contact: [email protected].
Article 7 — Limitation of liability
Section titled “Article 7 — Limitation of liability”7.1 Cap. In all circumstances, the total liability of the Publisher to the Customer, for all causes combined, is limited to the amount actually paid by the Customer in the 12 months preceding the incident.
7.2 Exclusion of certain damages. The Publisher shall not be held liable for indirect, intangible, or consequential damages, including: loss of revenue, loss of customers, reputational damage, administrative penalty related to EAA non-compliance, compliance costs for the developed application.
7.3 Aid tool. The Publisher shall not be liable for design or development decisions made based on the plugin’s results, nor for the consequences of non-compliance of the final application. The Customer remains solely responsible for the compliance of their deliverables with the legal obligations applicable to them.
Article 8 — Intellectual property
Section titled “Article 8 — Intellectual property”8.1 Plugin. The A11y Audit plugin, its source code, analysis algorithms, interface, and PDF reports are the exclusive property of the Publisher. They are protected by copyright.
8.2 License. The Publisher grants the Customer a personal, non-exclusive, non-transferable license to use the plugin, limited to the duration of the subscription. This license confers no rights to the source code.
8.3 Customer content. Audited Figma mockups and generated PDF reports remain the property of the Customer. The Publisher claims no rights over this content.
Article 9 — Personal data
Section titled “Article 9 — Personal data”9.1 Data controller. The Publisher is the data controller for personal data collected in the context of the service.
9.2 Data collected. The Publisher collects only data strictly necessary for subscription management:
- Email address (for sending the license key, subscription notifications, and support)
- License identifier (to validate the subscription when the plugin opens)
The Publisher does not collect any data from Figma mockups. The plugin runs locally in the Customer’s Figma environment.
9.3 Legal basis. Data is processed for the performance of the subscription contract (GDPR Art. 6.1.b) and, with the Customer’s consent, for commercial communications (GDPR Art. 6.1.a).
9.4 Retention. Management data is retained for the duration of the subscription and 3 years after termination (accounting and legal obligations). Support data is deleted 1 year after ticket closure.
9.5 Rights. The Customer has rights of access, rectification, erasure, restriction, portability, and objection. These rights are exercised at: [email protected].
Article 10 — Governing law and jurisdiction
Section titled “Article 10 — Governing law and jurisdiction”These ToS are governed by French law.
In case of dispute, the parties undertake to seek an amicable solution within 30 days of notification by registered letter. Failing amicable resolution, the dispute shall be submitted to the exclusive jurisdiction of the Commercial Court of Paris.
